Medics S.r.l. with operational headquarter in Via Amedeo Avogadro n. 19 – 10121 Turin (hereinafter “Medics”), as Data Controller of personal data according to the Italian legislation applicable pro tempore on the protection of personal data (the “National Legislation”) and EU Regulation 679/2016 – General Data Protection Regulation (“RGPD”) (hereinafter the National Legislation and the GDPR are collectively referred to as “Applicable Regulations”), recognizes the importance of the protection of personal data and considers its protection one of the main objectives of its business.

Before communicating any personal data, Medics invites you to read this privacy policy (“Privacy Policy”) carefully, as it contains important information on the protection of personal data and on the security measures taken to guarantee its confidentiality in full compliance with the Applicable Regulations. Furthermore, this Privacy Policy is intended only for the site www.medics3d.com (“Site”) while it does not apply to other websites that may be consulted through external links; it is to be understood as Information provided according to Article 13 of the Applicable Legislation to those who interact with the Site.

Concerning the Applicable Regulations, we inform you that the Data Controller is Medics whose data are reported on the website on the Home Page and/or on other web pages of the same.

The Data Controller has appointed the Data Protection Officer (DPO) who can be contacted at the following e-mail: privacy@medics3d.com.

  1. PERSONAL DATA SUBJECT TO PROCESSING

“Personal Data” means any information relating to an identified or identifiable natural person with particular reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity.

The Personal Data collected by the Site are as follows:

  1. Navigation data

The computer systems of the Site collect some Personal Data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with you, but by its very nature could, through processing and association with data held by third parties, allow you to be identified. Among these are the IP addresses or domain names of the devices used to connect to the Site, the addresses in URI (Uniform Resource Identifier) notation of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful,  error, etc.) and other parameters related to your operating system and computer environment.

These data are used in order to obtain anonymous statistical information on the use of the Site and to check its correct functioning; to allow – given the architecture of the systems used – the correct provision of the various features requested by you, for security reasons and to ascertain responsibility in the event of hypothetical computer crimes against the Site or third parties and are deleted after 7 days, in any case, such data are kept by the Site Owner for the period strictly necessary and in any case in compliance with the current regulatory provisions on the subject.

  1. Data provided voluntarily

Through the Site, you can voluntarily provide Personal Data to contact Medics. Users are free to provide their personal data but failure to provide them may make it impossible to obtain the requested service. Medics will process these data in compliance with the Applicable Regulations, assuming that they refer to you or to third parties who have expressly authorized you to provide them based on an appropriate legal basis that legitimizes the processing of the data in question. Concerning this last hypothesis, you place yourself as an independent data controller, assuming all the obligations and responsibilities of the law. In this sense, you confer on this point the widest indemnity for any dispute, claim, request for compensation for damage from processing, etc. that should reach Medics from third parties whose Personal Data have been processed through your use of the Site in violation of the Applicable Regulations.

  1. Cookies and related technologies

Medics does not use cookies for user profiling. The only processing that could be carried out concerns the production of statistics, with pseudonymized data, on navigation on the Site.

Technical session cookies (non-persistent) are used, strictly limited to what is necessary for the safe and efficient navigation of the sites. More information on the use of cookies and tracking systems can be found here.

  1. PURPOSE, LEGAL BASIS, AND MANDATORY OR OPTIONAL NATURE OF THE PROCESSING

The Personal Data you provide through the Site will be processed by Medics for the following purposes:

  1. a) purposes related to the execution of a contract of which you are a party or to the execution of pre-contractual measures adopted at your request (eg: contact request through the Contact form or e-mail etc.);
  2. b) purposes of statistical research/analysis on aggregated or anonymous data, without the possibility of identifying the user, aimed at measuring the functioning of the Site, measuring traffic, and evaluating usability and interest;
  3. c) purposes related to the fulfillment of a legal obligation to which Medics is subject;
  4. d) purposes necessary to establish, exercise, or defend a right in court or whenever the courts exercise their judicial functions.

The legal basis for the processing of Personal Data for the purposes referred to in point a) is the provision of a service or the response to a request that does not require consent under the Applicable Regulations.

The purpose referred to in points b) does not involve the processing of Personal Data, while the purpose referred to in points c) and d) represents a legitimate processing of Personal Data under the Applicable Legislation because, once the Personal Data have been provided, the processing is indeed necessary to fulfill a legal obligation to which Medics is subject. The provision of your Personal Data for the purposes listed above is optional, but failure to provide it may make it impossible to find your request or fulfill a legal obligation to which Medics is subject.

  1. MODALITIES
  2. Tools and logic. Concerning the aforementioned purposes, the processing takes place using manual, computerized and telematic tools with logic strictly related to the aforementioned purposes and, in any case, in order to guarantee the security and confidentiality of the data and with the commitment on your part to promptly notify us of any corrections, modifications, and updates. This processing may be carried out on behalf of the Data Controller for the purposes and in the manner described above and in compliance with criteria suitable for guaranteeing security and confidentiality, by companies, firms, bodies, and external collaborators appointed as Managers and only concerning the treatments carried out by them.
  3. Special categories of data. None of your personal data at the Data Controller are attributable to the definition of “Special categories of data” of art. 9 of EU Regulation 2016/679. If you transmit data of this kind to us, in the absence of your explicit written consent, we will delete them immediately.
  4. RECIPIENTS

Your Personal Data may be shared, for the purposes specified in point 3, with:

  1. subjects necessary for the provision of the services offered by the Site, including by way of example the analysis of the functioning of the Site, who typically act as data processors of Medics;
  2. persons authorized by Medics to process Personal Data who are committed to confidentiality or have an adequate legal obligation of confidentiality; (e.g. employees and collaborators of Medics); (a. and b. are collective “Recipients”);
  3. judicial authorities in the exercise of their functions when required by the Applicable Regulations.
  4. TRANSFERS

Some of your Personal Data is transferred to Recipients who may be located outside the European Economic Area. Medics ensures that the electronic and paper processing of your Personal Data by the Recipients takes place in compliance with the Applicable Regulations. Indeed, transfers are based alternately on an adequacy decision or the Standard Model Clauses approved by the European Commission.

  1. DATA RETENTION

C Medics will process your Personal Data for the time strictly necessary to achieve the purposes indicated in point 3. Without prejudice to the above, Medics will process your Personal Data up to the time allowed by Italian law to protect its interests (Articles 2946 and 2947 (1) (3) of the Italian Civil Code). More information about the retention period of Personal Data and the criteria used to determine this period can be requested by writing to privacy@medics3d.com

  1. YOUR RIGHTS

Within the limits of the Applicable Regulations, you have the right to ask Medics, at any time, for access to your Personal Data, the correction or cancellation of the same or to oppose their processing, the limitation of processing as well as to obtain in a structured format, commonly used and readable by automatic device the data concerning you.

Under the Applicable Regulations, you have in any case the right to complain with the competent supervisory authority (Guarantor for the Protection of Personal Data) if you believe that the processing of your Personal Data is contrary to current legislation.

 

  1. CHANGES

This Privacy Policy has been in force since 25 May 2018. Medics reserves the right to modify or simply update its content, in part or completely, also due to changes in the Applicable Regulations. Medics will inform you of such changes as soon as they are introduced and will be binding as soon as they are published on the Site. Medics, therefore, invites you to regularly visit this section to become aware of the most recent and updated version of the Privacy Policy so that you are always updated on the data collected and on the use that Medics makes of it.
